Terms of Service
Last updated: October 15, 2026
These Terms of Service are an agreement between you and ThumbSpark (“ThumbSpark”, “we”, “us”) and apply whenever you use thumbspark.co. Please read them together with our Privacy Policy.
1. Agreeing to these terms
By creating an account or using ThumbSpark (thumbspark.co and its AI thumbnail tools), you agree to these Terms and to our Privacy Policy. If you use ThumbSpark for a company, you confirm you can accept these Terms on its behalf. If you don't agree, please don't use ThumbSpark.
2. The service
ThumbSpark is an AI-powered tool for designing thumbnails and related graphics. You describe what you want in a chat, add characters, reference images and other context, and AI models generate images and text for you. Features may change, be added or be removed over time.
3. Your account
- You must be at least 13 years old (or the minimum age in your country) to use ThumbSpark.
- Give accurate information and keep your password safe. You're responsible for activity on your account.
- Tell us right away at hello@thumbspark.co if you think someone else has accessed your account.
4. Plans, credits and payments
Credits plans. Subscriptions and credit packs run on our AI provider accounts. Each generation's actual AI cost is deducted from your credit balance (100 credits = US$1 of AI cost). Subscriptions renew automatically each month or year until cancelled, and add their credits at each renewal. Purchased credits don't expire while your account is open.
Lifetime plan. A one-time payment gives ongoing access to ThumbSpark using your own AI provider API keys. You pay those providers directly for your usage and are responsible for following their terms. “Lifetime” means for as long as ThumbSpark is offered.
Free trial. Where offered, a trial requires a payment card. Unless you cancel before it ends, you'll be charged for the plan you chose when the trial ends.
Billing. Payments are processed by Stripe. Prices are shown before you pay and may change for future billing periods; we'll tell you before a change affects an active subscription. You can cancel a subscription any time in Settings → Billing; it stays active until the end of the period you've paid for.
Refunds. Because AI generation has a real cost the moment it runs, payments and used credits are generally non-refundable, except where the law requires otherwise. If something went wrong, contact us at hello@thumbspark.co and we'll look at it fairly.
5. Your content
You keep ownership of what you upload (“Your Content”) and, to the extent the law allows, of the thumbnails generated for you (“Outputs”). You give us a limited permission to store, process and display Your Content and Outputs only to run ThumbSpark for you — including sending them to the AI providers that perform your requests.
You confirm that you have the rights needed for everything you upload, including permission from any person whose face or likeness you add as a character, and the rights to any logos, images or YouTube videos you use.
6. Acceptable use
You agree not to use ThumbSpark to create or share content that:
- is illegal, sexually explicit, involves minors in any sexual or harmful way, or promotes violence or hatred;
- impersonates or deceptively depicts a real person, or uses someone's likeness without permission;
- infringes copyrights, trademarks or other rights;
- is designed to mislead viewers in a harmful way (for example, scams or fake endorsements).
You also agree not to break, overload or probe the service, get around limits or payments, resell access without our permission, or use automated means to access it except through features we provide. We may remove content or suspend accounts that break these rules.
7. AI outputs
AI can make mistakes and can produce results that are inaccurate, similar to other content, or not what you asked for. Review every Output before you use it, and don't rely on it as professional advice. We don't guarantee that any thumbnail will increase views, clicks or revenue.
8. Third-party services
ThumbSpark relies on other services — such as AI providers, Stripe, Google and YouTube. Your use of their features is also subject to their terms. We aren't responsible for third-party services, and their availability can affect ours. YouTube transcript import works only for public or unlisted videos.
9. Our rights
ThumbSpark — its software, design, templates and brand — belongs to us and our licensors. These Terms give you the right to use the service, not ownership of it. If you send us feedback, we may use it freely.
10. Suspension and closing your account
You can stop using ThumbSpark and ask us to delete your account at any time. We may suspend or close accounts that break these Terms, put others at risk, or don't pay. If we close your account without a good reason, we'll refund any prepaid, unused subscription time.
11. Disclaimers
ThumbSpark is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose, and don't promise the service will be uninterrupted or error-free.
12. Limitation of liability
To the extent the law allows, ThumbSpark is not liable for indirect, incidental or consequential losses, or for lost profits, revenue, views or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that can't be limited by law.
13. Your responsibility
You agree to cover our reasonable losses and costs if a claim is brought against us because of Your Content, your Outputs as you use them, or your breach of these Terms.
14. Changes to these terms
We may update these Terms. We'll post the new version here with a new “Last updated” date and, for significant changes, tell you by email or in the app. Continuing to use ThumbSpark after a change means you accept the new Terms.
